Subject - Implementation of the Pre-natal Diagnostic Techniques (Regulation and Prevention of Misuse) Act, 1994 - clarification sought by Government of Punjab- reg.

Sir,
I am directed to refer your letter No. PNDT-FW-1(4)/Pb./98/4198 dated 01.09.1998, I FW (4) Pb/98/49 dated 11.01.1999 and this Department's letter of even number5s dated 8
th October 1998 on the above noted subject and to convey the views of Ethical Committee, Indian Council of Medical Research (ICMR), on the X-Y Chromosomal Separation of the Sperms for pre-determination of sex.

"The Pre-natal Diagnostic Techniques (regulation and Prevention of Misuse) Act, 1994 clearly states that the Act is provided for prevention of pre-natal sex determination and the person conducting the procedure should not communicate the sex of the foetus to the pregnant woman or her relatives, by words, signs or pregnant women. The question of pre-conceptual sex planning is not covered under this act."
